These General Contract Conditions for Purchases regulate the use of the website www.monix.es (hereinafter “The website”) that sells and advertises products under the name “MONIX”, which is a national registered trademark No. 2,972,132 and international trademark No. 1,060,248, currently owned by the company ISOGONA, SL, with registered office at ( 43800) Valls – Tarragona, Basters street nº 4, and provided with CIF B-60184843. Hereinafter “ISOGONA”.

The use of the website or placing an order through it implies full acceptance of the “General Contracting Conditions” described here, with respect to which ISOGONA reserves the right to unilaterally modify at any time, the conditions being applicable. current at all times those published on the website.

1. SCOPE OF THE CONTRACT

    By using this website and/or placing orders through it, you agree to:

    • Use this website only to make queries and/or legally valid orders.
    • Do not place any false or fraudulent orders. If it could reasonably be considered that an order of this nature has been made, we will be authorized to cancel it and inform the relevant authorities.
    • Provide us with your email address, postal address and other contact information truthfully and accurately. Likewise, you expressly consent that we may use said information to contact you if necessary (see Privacy Policy section). If you do not provide us with all the information we need, we will not be able to process your order.
    • By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts, especially for purchases accessed through the website.
        2. AVAILABILITY AND LIMIT OF THE SERVICE

          The items offered through this website are only available for shipping to Peninsular Spain, the Balearic Islands, Germany, Austria, Belgium, Bulgaria, Czech Republic, Croatia, Denmark, Estonia, Slovakia, Slovenia, Finland, France, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Romania and Sweden.

          For security reasons, purchases of more than €3,000.00 or more than 50 items per order cannot be made.

          3. PLACE AN ORDER

            To place an order, you will need to follow the online purchasing procedure and click "Buy Now" to complete the order. After this, you will receive an email acknowledging receipt of your order (the "Order Confirmation"). Additionally, we will inform you by email that the product is being shipped (the "Shipping Confirmation").

            4. PRICE

              The prices applicable to the products are those indicated at any time on the website on the date of the order. Prices are detailed in each article and include VAT (Value Added Tax). The amount of shipping costs is indicated to the customer in detail at the time the order is placed.

              5. PAYMENT

                Supported payment methods: Purchases can be paid with a credit card or debit card or through Paypal. In any case, the choice of payment method is made during the purchase process on the corresponding screen at no additional cost.

                The client must notify ISOGONA, if applicable, of any improper or fraudulent charge on the card used for purchases, by email or telephone, in the shortest possible time so that it can carry out the appropriate procedures. Providers or issuers of payment methods may adopt anti-fraud measures that entail the rejection of certain types of operations. ISOGONA is not responsible for the application of this type of security policies.

                6. DELIVERY

                  All orders to Peninsular Spain and Peninsular Portugal are made through MRW and DHL. If you make your purchase in our Monix store from Monday to Thursday before 4:00 p.m., you will receive your order within the next business day (within 24 hours). If you place the order after 4:00 p.m., you will receive it after one more day, within 48 hours.

                  If you place the order on Friday afternoon or during the weekend, it will arrive on Tuesday (if it is a holiday it will be delivered the next business day).

                  In the case of orders destined for the Balearic Islands, shipments are made through Tipsa and take 4 to 5 business days to arrive.

                  For orders to Germany, Austria, Belgium, Bulgaria, Czech Republic, Croatia, Denmark, Estonia, Slovakia, Slovenia, Finland, France, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Romania and Sweden we carry them through GLS and DHL.

                  6.1 Home delivery

                  Standard shipping in mainland Spain, the Balearic Islands and mainland Portugal: Shipping is free for orders over 30 euros of purchase. If you make a purchase of a lower amount, a transport cost of 4 euros will be applied. Delivery will always be in mainland Spain or the Balearic Islands.

                  Standard shipping in Germany, Austria, Belgium, Bulgaria, Czech Republic, Croatia, Denmark, Estonia, Slovakia, Slovenia, Finland, France, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Romania and Sweden: Shipping costs between 8.90 euros to 24.90 euros depending on the country and will be shown when completing the order in the shopping cart.

                  The address indicated by the client may be a private home, a workplace or any other address indicated. The billing address and shipping address do not need to match.

                  6.2 Delivery incidents

                  In the event that delivery is not possible due to the absence of the recipient, the transport agency will leave an indicative note and will try to contact the recipient by telephone. After two (2) failed attempts, it is the customer who must contact the transportation agency to proceed with the delivery.

                  7. EXCHANGES, RETURNS AND WITHDRAWAL.

                    There are different procedures for making returns and withdrawals. Below, we will describe the characteristics of each of them, as well as their costs and conditions.

                    • Return: in case of defect or defect.
                    • Withdrawal: by customer decision.

                    All products that are to be returned must be properly packaged, if possible in their original packaging.

                    7.1 Exchange and Return Conditions

                    If you have doubts about the chosen size or for any reason you decide to return the product, contact us by email ( tienda@monix.com ).

                    You can return any product within a period of 30 days, as long as it has not been used and has its original packaging. The returned product must be delivered to the transport company protected in a box (it can be the Monix transport box or another, but the product cannot be delivered directly to the carrier).

                    For returns in Peninsular Spain and the Balearic Islands, we will contact the transport agency to pick up the product at no cost to the customer.
                    For returns outside of Spain, we must receive the product at this address: Monix, Josep Comas i Solà 19A, 08243 Manresa (Spain). We can also collect at the customer's expense.

                    The refund amount will be made through the same payment method that you used to make the purchase or through a discount voucher (without expiration date).

                    Can I exchange any of the products received for another? If you want to make an exchange, it will be managed as a return and the amount of the product will be refunded once it is received and checked in our warehouse. The new product can be purchased at any time by placing a new order.

                    7.2 Withdrawal Conditions

                    7.2.1 Right of withdrawal

                    If you are contracting as a consumer and user, you have the right to withdraw from this contract within a period of fourteen (14) calendar days without the need for justification.

                    The withdrawal period will expire fourteen (14) calendar days from the delivery of the purchased product, from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods or in the event of that the goods that make up your order are delivered separately, fourteen (14) calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the last of those goods.

                    To exercise the right of withdrawal, you must expressly notify ISOGONA in writing, either by postal mail to the address, (43800) Valls - Tarragona, Basters street nº 4, or by writing to the email “ tienda@monix.com ”, stating their unequivocal decision to withdraw from the contract.

                    To withdraw, you may use the model withdrawal form that appears as an Annex at the end of these Conditions, although its use is not mandatory. To comply with the withdrawal period, it is sufficient for the communication regarding your exercise of this right to be sent before the corresponding period has elapsed.

                    7.2.2 Consequences of withdrawal

                    Once the withdrawal has been formalized and the item has been returned properly packaged, if possible in its original packaging, the price will be refunded as soon as possible, and in any case, within the following fourteen (14) calendar days.

                    We will proceed to make said refund using the same payment method used by you for the initial transaction, unless you tell us otherwise, for which you must expressly detail in your withdrawal the new payment method through which you want us to make the refund. . You will not incur any costs as a result of the refund.

                    Notwithstanding the above, we may withhold the refund until we have received the goods, or until you have presented proof of their return, depending on which condition is met first.

                    8. PRODUCT AVAILABILITY

                      If there are incidents regarding its supply or if there are no products in stock, you will be informed immediately and the amount of the product or products out of stock will be refunded. ISOGONA will refund the corresponding amount without undue delay and, in any case, before fourteen (14) calendar days have elapsed. The refund will be made by the same payment method with which it was paid. The stock availability data in the physical store reflected on our website is intended to be exact but is indicative and may vary depending on purchases.

                      9. LEGAL WARRANTY OF THE PURCHASED PRODUCTS

                        The legal guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users.

                        The term of this warranty is three (3) years from the date of receipt of the product at the address indicated for this purpose for products purchased after January 1, 2022. Products purchased before January 1 from 2022 have a warranty period of two (2) years.

                        The warranty covers possible manufacturing defects, and DOES NOT cover defects resulting from misuse of the product, nor those derived from improper or inadequate use, nor damage caused by impacts.

                        The consumer has two (2) months from receipt of the product to notify the seller of a possible defect, who will notify the seller via the following e-mail: tienda@monix.com . Possible defective products covered by this warranty will be received, repaired and/or replaced free of charge, and returned to the buyer free of charge.

                        10. CUSTOMER SERVICE

                          ISOGONA's online sales Customer Service will attend to and respond to your claim as soon as possible, it will be available from Monday to Friday from 9:00 a.m. to 6:00 p.m., and in any case the response will be given within a maximum period of one month.

                          11. FORCE MAJEURE

                            Compliance by ISOGONA with all or part of its obligations will be suspended in the event that a fortuitous event or force majeure occurs that prevents or delays compliance. They will be considered as such, in particular, without this list being limiting: war, riots, insurrection, social unrest, strikes of any nature and supply problems not attributable to ISOGONA. ISOGONA will inform the client of the occurrence, if applicable, of a fortuitous event or force majeure within seven (7) days after its occurrence. In the event that said suspension extends beyond a period of fifteen (15) days, the customer will then have the possibility of terminating the order in progress and the refund will then be made under the conditions provided for in point 6 of the these General Purchase Conditions.

                            12. APPLICABLE LAW AND JURIDISCTION

                              These General Purchase Conditions are subject to Spanish legislation. Being applicable (Recast Text of the General Law for the Defense of Consumers and Users) in everything that is not provided for in this contract.

                              ISOGONA is not a member of any association or organization that offers an extrajudicial conflict resolution system.
